Adventure Pack LLC Terms of Service & Liability Waiver
Adventure Pack LLC (“Adventure Pack,” “we,” “our,” or “us”) provides dog walking, hiking, and related pet care services. By signing below, you (“Owner,” “you,” or “your”) agree to the terms set forth in this Agreement (the “Terms”). These Terms of Service & Liability Waiver (“Terms”) apply to all services provided by Adventure Pack now and in the future and remain in effect until terminated in writing by either party.
1. Owner Representations & Responsibilities
You represent that you are the legal owner of the pet(s) receiving services, have disclosed all relevant health and behavioral information, and will keep this information current.
You grant Adventure Pack access to your property as needed to provide services and agree to secure your home appropriately.
You will provide safe and appropriate collars, harnesses, and any required gear.
You acknowledge that Adventure Pack may walk or hike multiple compatible dogs together at its discretion.
You acknowledge that Adventure Pack may refuse or discontinue service at its discretion if a dog exhibits aggressive or unsafe behavior. Adventure Pack is not a professional dog trainer and does not guarantee or take responsibility for any changes in behavior.
2. Off-Leash Authorization & Risk Assumption
Adventure Pack may, in its professional judgment, allow your dog(s) to participate in off-leash activities in legal and appropriate areas (including dog parks, hiking trails, and designated off-leash spaces).
You acknowledge that off-leash activity carries inherent risks, including the risk of injury, escape, or interactions with other animals. You authorize Adventure Pack to make off-leash decisions at its discretion, and you agree that Adventure Pack will not be liable for any injury, loss, or damage resulting from such activities except in cases of gross negligence or intentional misconduct.
3. Liability Waiver & Indemnification
You understand and accept that:
Pets can behave unpredictably, and Adventure Pack cannot guarantee control over your pet at all times.
Adventure Pack is not liable for illness, injury, escape, loss, or property damage involving your pet(s) except in cases of gross negligence or intentional misconduct.
You are responsible for any injury, damage, or costs arising from your pet’s actions, including injury to Adventure Pack staff, third parties, or other animals.
You agree to indemnify and hold harmless Adventure Pack and its employees, contractors, successors, and assigns from any claims, damages, liabilities, costs, or expenses (including veterinary bills and attorney’s fees) arising from your pet’s behavior or your breach of these Terms.
4. Veterinary Authorization
If your pet requires emergency veterinary care and you cannot be reached, Adventure Pack is authorized to act on your behalf to obtain such care. Adventure Pack will not be liable for any injury, loss, or damage resulting from such decisions that are made in these situations.
5. Keys & Access
Owner authorizes Adventure Pack to retain keys, remote controls, and access codes as needed to provide services. Adventure Pack will take reasonable steps to safeguard such access information and will return it upon request or termination. Adventure Pack is not responsible for loss, theft, or damage to the premises if other persons have access during the same period or if loss occurs through no fault of Adventure Pack.
6. Emergency Contact
Owner authorizes Adventure Pack to contact the designated emergency contact and/or the pet’s veterinarian if the Owner cannot be reached during an emergency.
7. Service Policies
Adventure Pack maintains policies (“Service Policies”) that govern scheduling, cancellations, office hours, holiday surcharges, and other operational matters.
These Service Policies will be provided to you in written or electronic form during onboarding.
Adventure Pack may update the Service Policies from time to time on its website and will supersede any prior Service Policies. You will receive notice of any material changes by email, text message, or other reasonable means. Continued use of Adventure Pack’s services following such notice constitutes acceptance of the updated policies. Adventure Pack may, at its discretion, require a new signature if material changes occur. The Service Policies are incorporated herein by reference.
8. Non-Solicitation of Staff
You agree not to directly or indirectly hire, solicit, or engage Adventure Pack staff for private pet care services during the term of your relationship with Adventure Pack and for twelve (12) months thereafter.
8.5 Text Message (SMS/MMS) Consent
A. Service Messages: You agree that Adventure Pack may send you non-marketing, informational text messages regarding the services you have scheduled, including walker arrival/departure times, urgent updates, and emergency communications.
B. Marketing Messages (Express Consent): By signing this Agreement, you expressly consent to receive marketing, promotional, and commercial text messages from or on behalf of Adventure Pack at the phone number provided. Message frequency will vary. Standard message and data rates may apply. You understand that consent is not a condition of purchasing any property, goods, or services.
C. Opt-Out: You may opt-out of receiving marketing text messages at any time by replying STOP to any marketing text message you receive. Reply HELP for assistance.
9. Photo & Media Release
Owner grants Adventure Pack permission to photograph, film, and otherwise record their pet(s) during services. The collection and use of this media, along with all other personal information, is governed by the Adventure Pack Privacy Policy, which is incorporated by reference. Adventure Pack may use such images and recordings, including the pet’s name, likeness, and general location (e.g., “Scarsdale”) for promotional, marketing, and social media purposes, in any media, worldwide, without further notice or compensation to Owner.
Adventure Pack will not publish personally identifying information about the Owner (such as home address) without separate consent. Owner may revoke this permission in writing at any time, but revocation will not apply to materials already published.
10. Termination
Either party may terminate these Terms by written notice. These Terms apply to any services provided prior to termination.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New York. Any disputes shall be resolved by binding arbitration administered by the American Arbitration Association in Westchester County, New York. The prevailing party shall be entitled to recover reasonable legal fees and costs.
12. Entire Agreement
These Terms, together with the Service Policies, constitute the entire agreement between you and Adventure Pack. No verbal representations modify these Terms. Any signature (including any electronic symbol, clickwrap or process attached to, or associated with, a contract or other record and adopted by a Person with the intent to sign, authenticate or accept such contract or record) hereto or to any other agreement or document related to these Terms shall have the same legal validity and enforceability as a manually executed signature or use of a paper-based recordkeeping system to the fullest extent permitted by applicable Federal and State law and the parties hereby waive any objection to the contrary.
Owner Acknowledgment & Signature
By signing (pdf or otherwise) this agreement or acknowledging by clicking “I Agree” to these Terms via the Adventure Pack website or acknowledging these Terms via the Time to Pet software application, I acknowledge that I have read and understood these Terms. I agree to be bound by them and authorize Adventure Pack to provide services for my pet(s) in accordance with these Terms.
Adventure Pack Service Policies
1. Office Hours & Communication
Our office hours are Monday–Friday, 7:00 am to 7:00 pm.
Outside of business hours, you’ll receive an automated response. We’ll reply promptly on the next business day.
During business hours, we aim to respond to messages within 15 minutes.
2. Scheduling, Service Changes & Cancellations
To request a change or cancel a scheduled service, please let us know by 7:00 pm the evening before. Requests by that time will be honored.
Requests made after that deadline are tentative; we will try to accommodate but cannot guarantee.
Late cancellations (after 7:00 pm the night before) incur a 50% cancellation fee of the scheduled service.
If our staff arrives and cannot access your dog (locked door, no access, etc.), full service fee is due.
3. Onboarding / Meet & Greet
All new clients begin with a 30-minute Meet & Greet at your home.
During that session, we’ll:
get to know your dog (temperament, health, behavioral history)
confirm fit for our hikes / services (off-leash readiness, etc.)
review all policies & procedures with you
We reserve the right to decline enrollment if a dog does not meet our safety / compatibility criteria.
4. Off-Leash & Safety Protocols
Off-leash hiking is not automatic. Each dog is evaluated individually for recall, temperament, and safety.
Dogs that are not reliably responsive will be leashed for safety purposes, especially near trail ends or in higher-risk zones.
We use GPS tracking devices on collars of all dogs when hiking off-leash.
Our staff are experienced, trained in group dog management, first aid, trail safety, etc.
5. Health, Vaccination, and Behavior Requirements
Dogs must be up to date on vaccinations, flea/tick/parasite preventive care, and general veterinary health.
Dogs with contagious illnesses, or that present a risk to others, may be temporarily excluded until cleared by a veterinarian.
Behavioral issues (aggression, anxiety, etc.) will be assessed in the Meet & Greet. If behavior poses safety concerns, private walks may be required instead of group hikes.
6. Fees, Billing & Deposits
Service fees are established in our Pricing schedule; pricing may vary by frequency, group vs private, weekends, holidays, etc.
Clients must provide a valid payment method (e.g. credit card on file) before services begin.
Payment is typically invoiced weekly; payment terms / auto-billing will be made clear.
7. Holidays, Bad Weather & Exceptional Circumstances
We operate in most weather, but reserve the right to reschedule or cancel services if conditions are unsafe (lightning, extreme temperatures, dangerous trail conditions).
On holidays (as defined below), services may incur a surcharge or have limited offerings.
During peak times, boarding and other services may have stricter deposit / cancellation rules.

8. Right to Refuse or Modify Service
We reserve the right to refuse service or remove a dog from group hikes if at any time the dog poses risk to itself, other dogs, clients, or staff.
Reasons might include aggression, failure to follow behavior expectations, medical or injury concerns, or inability to follow recall or safety procedures.
In such cases, we’ll work with the client to find alternative solutions (private hikes / walks / training) where feasible.
10. Privacy, Media & Use of Data (See Privacy Policy)
The handling of all client personal data, including GPS tracking data, home access codes, health or behavioral information, and media, is governed by the full Adventure Pack Privacy Policy, available on our website.
11. Liability & Emergency Care
We carry pet-care liability insurance.
In case of accidental injury (from dog activities, trail hazards, etc.), we will notify the owner immediately.
Veterinary care costs for injuries sustained by a dog due to its own actions are the owner’s responsibility; if another dog causes injury, we’ll assist with mediation and reimbursement as appropriate.
